Oggi ho ricevuto un’e-mail non richiesta da un certo Google Position. Sito ben fatto, però. In portfoglio mettono gli indirizzi dei propri clienti, tra cui anche quello della loro stessa azienda (Non solo Web). Per fare numero, credo, un po’ come i mendicanti che a inizio giornata mettono loro stessi qualche spicciolo nel cappello.
Alla modica cifra di 59 euro più iva si offrono di inserire il tuo indirizzo nel motore di ricerca di Google, come se ce ne fosse bisogno.

IANAL, ma mi pare che se uno usa un marchio registrato di qualcun altro in modo che non gli faccia concorrenza e non induca confusione, allora è permesso. Es. se una ditta mettesse sul mercato un detersivo “Google”, con un logo molto diverso da quello di google.com, non sarebbe una infrazione del trademark.
Il sito che citi mi sembra un po’ al limite (almeno specificano chiaramente che il marchio google non è loro). Forse almeno formalmente sono a posto.
Staremo a vedere cosa ne penseranno i legali di google.
Be’, forse alla fine, a Google fa piu’ pubblicità che danno.
E piu’ che violazione del marchio (c’e’ anche un oculato disclaimer in proposito, che dice “Google è un marchio registrato Google Inc, Mountain View Ca, USA) direi che c’e’ millantato credito.
Infatti e’ da notare, oltre a loro stessi, la citazione di alcuni clienti in portfolio (e non vado oltre perche’ mi sono gia’ annoiato):

Mai abbiamo detto di essere Google. in ogni sezione del sito abbiamo sempre detto di essere Nonsolo-Web, così come diciamo al telefono.
Credo invece che la vostra sia solo invidia per qualcuno che ha avuto un’idea brilante.
